Terms and Conditions 

1 – Introduction

This document sets out the Terms of Use for the Broadford Life App (the 'BL App') and the Privacy Policy explaining how Broadford Life processes personal data in connection with the App. Part A contains the Terms of Use governing your access to and use of the BL App. Part B contains the Privacy Policy. In Part B, 'personal data' means information relating to any identifiable living individual.

The Data Protection Act 2018, the UK General Data Protection Regulation (UK GDPR), the Data (Use and Access) Act 2025, and the Privacy and Electronic Communications Regulations (PECR) seek to protect and enhance the rights of data subjects. 

These rights cover the safeguarding of personal data and protect against the unlawful processing of personal data.

This Privacy Policy is for Broadford Limited, and for the following operating name:

For the purposes of data protection and this Privacy Policy all entities will be referred to as Broadford Life or BL. In the event of any differences in data processing the relevant company name will be used in full.

BL is pleased to provide the following information about our terms and Privacy Policy:

2 - Who We Are

Broadford Limited, operating as Broadford Life (BL), is a developer and operator of homes for rent in the UK.

PART A – TERMS OF USE

3 – The App Service

The BL App is an app, designed and managed by Broadford Limited. The app allows residents access to certain information, facilities and services during the course of their tenancy agreement.

In providing the App Service, Broadford Life works with the following categories of third party who may have access to, or process data in connection with, the App: (i) the Property Manager, who manages day-to-day property management on behalf of the property owner and facilitates access to the App for authorised residents; (ii) Installers, who are granted limited, temporary access to the App solely for the commissioning of in-home smart home technology; and (iii) Cloud and Hosting Suppliers, who provide the technical infrastructure supporting the App. Each category of third party is subject to appropriate contractual data protection arrangements, including data processing agreements or equivalent obligations where required under applicable UK data protection law.

The following items are core features of the app which require the use of a smart phone running either iOS or an Android device to run the BL app:

The core features provided by BL are required by residents to gain access to their home, operate all available in-home smart technology, access tenancy information, communication and enjoy the benefits of their home controls.

Depending on your specific home, the App is enabled to control all relevant features.  As the registered and approved tenant you have the ability to disable any of the features, but please be aware this may affect the functionality and enjoyment of your home controls.

When you apply for a tenancy agreement, you will initially be directed to apply through one of Broadford Life’s appointed property managers, who operate independently of Broadford Life.  The Property Manager will operate their own systems and processes which they will set out to you when applying for a tenancy, and this should not be confused with BL. 

Details of the Property Manager will be included in your tenancy documentation or can be obtained by contacting Broadford Life at the address set out in this document.

Subject to your agreement and appropriate scoring and other checks, a tenancy offer may be made to you. Once finalised and confirmed by the Property Manager, the Property Manager will authorise your access to the BL app, and Broadford Life will then make available its BL App. When you download the app, you will be authorised for access by providing your email address which will need to match the information you provide to the Property Manager during the process of applying for your tenancy agreement.

Once you have downloaded and set up the app, all the relevant core features will be immediately available to use.  In addition, you will be able to access your tenancy documentation, home user guides and manuals, and access contacts for queries, communications and reporting maintenance items.  You will also be able to actively manage authorised access to the property for any maintenance appointments, in liaison with the Property Manager.

Installers

Installers have use of the BL app for a limited period, solely for the purpose of registering and commissioning the relevant smart home technology and hardware.  Installers will be provided access to download the app via provision of a valid email address.  The email address will be verified and access confirmed by the Property Manager.

4 – Terms of Use

Only ‘Authorised users’ of the BL App may download and access this app.  Authorised users may only be one of two categories; Residents and Installers. Residents may only be an Authorised user with a valid tenancy agreement, and Installers may only be an Authorised user by invitation only.

Residents

Applies to Residents only. You are a Resident accessing the BL App in connection with a residential tenancy. You are a consumer for the purposes of the Consumer Rights Act 2015 and the mandatory consumer provisions set out in this Part A apply to your use of the App.

Access to the BL App will have been provided to you for the purpose of accessing and enjoying your tenancy and the app features and home controls available through the app.

By downloading and setting up the BL app you agree to provide your email address, which will be used solely for the purpose of verifying your authorisation to access the app and the relevant associated property controls.

You agree and confirm that you have a valid tenancy agreement and will only use the app for the purpose of using the relevant features for your property.  The Property Manager may remove access to the app or disable functions if you are in breach of your tenancy agreement at any time.

In order for the app to operate effectively, the app communicates with the relevant technology and hardware to facilitate control of the core features of the app.  This includes battery levels, security enabling information, testing data, and energy use data in accordance with your tenancy agreement.

Installers

Applies to Installers only. Access to the BL App is granted to you on a business-to-business basis solely for the commissioning of in-home smart home technology. Consumer protection provisions, including those under the Consumer Rights Act 2015, do not apply to your use of the App.

Access to the BL App will have been provided to you for the purpose of registering and commissioning smart tech hardware and setting up relevant in-home controls, functionality and accurate registration. 

By downloading and setting up the BL app you agree to provide your email address, which will be used solely for the purpose of verifying your authorisation to access the app.

Upon verified completion of the tasks required by the agreed scope, and in-app instructions, you will delete the BL app and no further access will be granted or enabled.

Use of the App

Acceptable use: the App is provided for the purposes set out in Section 3.  Any misuse of the App or connected hardware, tampering, bypassing security, or any attempt to limit or affect the operation of the App will be considered a breach of these Terms and may result in removal of your authorisation to use the App and its connected services.  Please note this may also affect your tenancy agreement.

Service limitations; the operation of the app requires connectivity with the relevant hardware items, which all require power, wifi and hub access.  Removing any of these connections may impact the performance and functionality of the app. Such limitations are considered non-safety critical and all items can be physically operated.

Availability; Broadford Life will ensure best efforts to maintain consistent operations of the app, subject to the required connectivity being available.  Residents and Installer will be notified of any planned maintenance or service outage which may affect the use of the app, and any required guidance will be offered on the physical operation or back up of relevant hardware.

The BL App and all intellectual property rights in it are owned by or licensed to Broadford Limited. The connected in-home hardware is owned by either Broadford Limited or the relevant property owner (or their licensors). No ownership rights in the App or hardware are transferred to you by virtue of these Terms or your use of the App.

Intellectual Property Rights

The BL App, including all software, content, designs and technology forming part of it, is the exclusive property of Broadford Limited and/or its licensors. All intellectual property rights in the App are reserved to Broadford Limited.

Licence

Subject to these Terms, Broadford Life grants you a personal, limited, non-exclusive, non-transferable, revocable licence to download and use the BL App on a compatible device solely for the purposes described in these Terms. No other rights in or to the App are granted to you. For Installers, this licence is limited to the commissioning purpose described in Section 3 and terminates automatically upon completion of the relevant installation engagement.

Restrictions on Use

You must not: (a) copy, modify, adapt or create derivative works based on the App or any part of it; (b) reverse engineer, disassemble, decompile or otherwise seek to access the source code of the App; (c) use the App for any commercial purpose not expressly authorised by Broadford Life in writing; (d) remove, obscure or alter any proprietary notices, branding or labels on the App; (e) sublicence or make the App available to any person not authorised under these Terms; or (f) use the App in any way that is unlawful, harmful or that infringes any third party's rights. Breach of these restrictions may result in immediate termination of your access and may give rise to legal liability.

App Store Terms

If you download the BL App through Apple's App Store or Google Play Store, your use of the App is also subject to the applicable terms of Apple Inc. or Google LLC (as applicable). As between those platform providers and Broadford Life, Broadford Life is solely responsible for the App and its content. In the event of any inconsistency between these Terms and the relevant platform terms, these Terms shall prevail to the extent permitted by law.

Changes to the App and These Terms

Broadford Life may update or modify the App and these Terms from time to time. If we make material changes to these Terms, we will notify you through the App or by email to the address associated with your account, giving reasonable notice (normally not less than 30 days) before the changes take effect. Your continued use of the App after that date constitutes your acceptance of the updated Terms. If you do not wish to accept the changes, you should stop using the App and contact Broadford Life. Changes required immediately by law or for security reasons may take effect without prior notice.

Suspension and Termination of Access

Broadford Life may suspend or terminate your access to the BL App, with or without notice, if: (a) you breach these Terms or your tenancy agreement (for Residents); (b) your tenancy agreement ends or is terminated (for Residents); (c) your installation engagement is complete or terminated (for Installers); (d) continued access presents a security risk to the App, the connected hardware or other users; or (e) Broadford Life is required to do so under any agreement with the relevant property owner or by applicable law. Access may also be suspended with advance notice for planned maintenance or necessary App updates.

On termination of your access, your licence to use the App ends immediately and you must promptly delete the App from your device. Termination does not affect any rights or obligations that accrued before the date of termination.

Governing Law

These Terms of Use are governed by and construed in accordance with the laws of England and Wales. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, save that nothing in this clause prevents a Resident from relying on mandatory consumer protection rights applicable under English law.

Consumer Rights (Applies to Residents only)

By downloading and setting up the BL App, you consent to the digital service commencing immediately. By providing such consent, you acknowledge that you waive your right to cancel during the 14-day statutory withdrawal period that would otherwise apply under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. This does not affect your rights under the Consumer Rights Act 2015 if the App service does not conform to these Terms. If you have a complaint about the App service, please contact Broadford Life in the first instance using the contact details in Section 3 above.

Limitation of Liability

Nothing in these Terms excludes or limits Broadford Life's liability for: (a) death or personal injury caused by its negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot lawfully be excluded or limited. Subject to this, Broadford Life is not liable for any loss or damage arising from connectivity failures, hardware malfunctions, third-party service failures, or other circumstances beyond its reasonable control. If you are an Installer accessing the App on a business-to-business basis, Broadford Life's total liability arising out of or in connection with your use of the App shall not exceed £100.

5 – App Data

Broadford Limited is a controller of data for the purpose of providing the app service.

Mandatory data: in order for the App to operate fully and control the relevant in-home technology and hardware, the data processed is technology event data. This event data provides for the effective operation of all the core features and systems, and includes account identifiers, operational signals, energy management data, alarm triggers, device health and audit logs. The App may also collect limited usage and diagnostic data to monitor App performance and support its operation and improvement. Such data is processed on the basis of legitimate interests and is aggregated or pseudonymised where reasonably practicable.
